These Terms apply to tutoring, educational support, courses, group programmes, academic resources, digital services, institutional programmes and related services supplied through ACT Tuition. A submitted application is a request for service and is not itself confirmation of a tutor, timetable, price, place, location or start date. Mandatory consumer rights that cannot lawfully be excluded remain unaffected.

1. Applications, bookings and withdrawal rights

An application or enquiry asks ACT Tuition to consider the learner's or organisation's requirements. A booking becomes confirmed only when ACT Tuition communicates acceptance of the service arrangement, including the relevant service, delivery format, timetable and applicable fee or commercial proposal. Where a statutory cooling-off or withdrawal right applies to a distance or off-premises consumer contract, that right remains available in accordance with applicable law. Formal withdrawal requests should be sent to [email protected]. Where a consumer expressly asks for tuition or another service to begin during an applicable withdrawal period, payment may remain due for services already supplied to the extent permitted by law.

2. Information supplied by applicants

Applicants must provide information that is reasonably accurate and sufficient for matching, safeguarding, scheduling and service delivery. This can include contact details, learner level, subject, examination board, delivery preference, location, availability and relevant learning objectives. Applicants should not submit passwords, payment-card data or unnecessary sensitive personal information through general enquiry forms.

3. Cancellation and rescheduling of tuition

Requests to cancel or reschedule a booked tuition slot should normally be sent to ACT Tuition at least 48 hours in advance. Rescheduling is subject to tutor and learner availability and will normally be sought within the same week or the following week where practical. ACT Tuition may request reasonable supporting information where exceptional circumstances, including illness, are relied upon. A session cancelled outside the required procedure may be forfeited and remain payable, subject to mandatory consumer rights and any exception ACT Tuition agrees in writing.

4. Ending ongoing tuition

Ongoing tuition should normally be ended with at least three weeks' written notice to ACT Tuition. Lessons falling within an applicable notice period remain payable unless ACT Tuition agrees otherwise or applicable law requires a different outcome. Where a programme was sold on a clearly disclosed discounted commitment, early termination may result in recalculation at the applicable standard rate and any agreed notice charge, but only to the extent lawfully and transparently agreed before purchase.

5. Safeguarding and in-home tuition

Where in-home tuition involves a minor, a parent, legal guardian or responsible adult designated by the parent or guardian must normally remain present in the home for the duration of the lesson unless ACT Tuition has approved another arrangement in writing. The client must provide a safe and appropriate learning environment. Communication, conduct and boundaries must remain professional. Safeguarding concerns should be raised promptly through ACT Tuition.

6. Fees and price confirmation

The applicable fee depends on the service, learner level, delivery format, duration, programme, location, group size and any institutional scope. ACT Tuition will not infer or invent a price. The price payable is the rate or proposal communicated by ACT Tuition before the relevant booking or purchase is confirmed. Where taxes or other legally required charges apply, these will be handled in accordance with the applicable invoice or confirmation.

7. Payment and overdue balances

Payment timing and method will be stated in the booking confirmation, invoice or commercial proposal. ACT Tuition may require payment in advance for upcoming lessons, programmes, resources or institutional delivery. Unless a different written arrangement applies, ACT Tuition may apply the same late-payment administration framework used across its tutoring operations: €25 after 10 working days, €50 after 20 working days, and interest at 8% per annum on overdue balances after 30 working days, in each case only to the extent legally enforceable, proportionate and properly communicated. ACT Tuition may pause further services while an undisputed balance remains overdue.

8. Official communication and tutor contact

Scheduling, payments, complaints, contractual changes, cancellations and termination notices should be handled through ACT Tuition. Clients must not use access to an ACT Tuition tutor to bypass ACT Tuition by arranging a private engagement intended to circumvent the ACT Tuition relationship. This restriction applies only to the extent that it is lawful, reasonable and necessary to protect legitimate business relationships.

9. Group tuition and cohort changes

Group tuition is subject to the agreed cohort structure. Where one participant cannot attend, the session may continue for the remaining participants and may remain chargeable. If a closed group changes size, ACT Tuition may revise the commercial arrangement for the remaining participants and will communicate the revised position before it applies. Places in open cohorts remain subject to capacity and programme rules.

10. Tutor assignment and reassignment

ACT Tuition may select or propose tutors according to subject, level, examination route, delivery mode, availability and other relevant matching factors. A requested tutor or timetable is not guaranteed until confirmed. If a tutor becomes unavailable, ACT Tuition may propose a suitable replacement. Clients may request reassignment where the fit is not appropriate. Continuing tuition does not remove the right to raise a substantiated complaint later.

11. Recording, screenshots and lesson materials

No lesson may be recorded, screen-captured, published or redistributed without the permissions and lawful basis required for that activity. Where ACT Tuition proposes recording for quality, training or another legitimate purpose, the appropriate notice and consent process will be used where required. Approved recordings and session materials must not be shared beyond the authorised purpose.

12. Continuity and changes in delivery mode

If circumstances make the agreed in-person delivery impracticable, ACT Tuition may offer an online alternative where appropriate. A material change to the agreed service will be communicated and handled in accordance with applicable contractual and consumer-law requirements. Online delivery remains subject to suitable connectivity, equipment and a safe learning environment.

13. Refunds

Refund eligibility depends on the service purchased, work already supplied, cancellation timing, applicable notice requirements and mandatory consumer law. Fixed-date programmes, business services or specialist classes may have specific cancellation or non-refundable conditions where those conditions are lawfully disclosed before purchase. Digital content that has already been supplied or accessed is subject to the statutory rules governing digital content and any valid request for immediate supply.

14. Public holidays and exceptional closures

Lessons are not automatically scheduled on public holidays unless expressly arranged. ACT Tuition may need to change delivery because of events outside reasonable control, including severe disruption, illness, safety issues, platform failure or venue unavailability. Where possible, ACT Tuition will offer a reasonable alternative rather than silently cancelling the service.

15. Trials and retention of lesson slots

Where ACT Tuition offers a trial or initial session, continued availability of the same tutor or slot is not guaranteed unless continuation is confirmed. ACT Tuition may set a reasonable deadline for retaining a provisional slot. If confirmation is not received within that period, the slot may be released to another learner.

16. Tutor identity, credentials and non-circumvention

ACT Tuition does not provide unnecessary private tutor data to clients. Tutor information may be reviewed internally for matching, quality and operational purposes. A client must not solicit, employ or engage an assigned ACT Tuition tutor privately in order to bypass ACT Tuition where such a restriction is lawful and enforceable. Nothing in this clause removes rights that cannot lawfully be waived.

17. Portal accounts and account security

Student, parent and tutor portal accounts are personal to the authorised user. Login credentials must not be shared publicly or with unauthorised persons. Users must take reasonable steps to protect their account and notify ACT Tuition if they suspect unauthorised access. ACT Tuition may suspend or reset access where necessary to protect learners, data or service integrity.

18. Academic integrity and AI-assisted tools

Tuition, notes, examples, study tools, research guidance and AI-assisted features are educational supports. Learners remain responsible for complying with the rules of their school, university, examination board or other institution, including plagiarism, authorship and artificial-intelligence policies. ACT Tuition does not complete assessed work on behalf of a learner and does not guarantee a particular grade, admission decision or academic result.

19. Notes, resources and intellectual property

ACT Tuition learning materials, website tools, written resources and other original content remain protected by applicable intellectual-property rights. Purchased or assigned resources are for the authorised learner or client unless a broader licence is expressly granted. Resources must not be republished, resold, uploaded to public repositories or redistributed without permission.

20. Home-education and curriculum responsibility

Where ACT Tuition supports home education, travel schooling, international curricula or private-candidate preparation, the family remains responsible for complying with the legal, registration, attendance, assessment and curriculum requirements that apply in the learner's jurisdiction. ACT Tuition provides educational support and does not replace legal advice or the responsibilities of the parent, guardian, school or competent authority.

21. Institutional and organisational programmes

School, employer, university, public-sector and partner programmes may be governed by an additional proposal, purchase order, service agreement or statement of work. Where there is a conflict between these public Terms and a separately signed institutional agreement, the signed agreement governs the specific programme to the extent stated in that agreement. Programme scope may include participant numbers, delivery mode, timetable, reporting, safeguarding responsibilities, data requirements, invoicing and cancellation terms.

22. Privacy and personal data

Personal information submitted through ACT Tuition is handled in accordance with the applicable Privacy Policy and data-protection obligations. ACT Tuition seeks to collect only information reasonably needed for the service. Parents and guardians must provide information about minors responsibly. Applicants should use official ACT Tuition channels rather than sending unnecessary personal data directly to tutors.

23. Complaints, service concerns and limitation of promises

Complaints should first be sent to [email protected] with enough information for ACT Tuition to investigate. ACT Tuition will not promise a particular tutor, grade, examination result, university admission, employment outcome or business result unless that promise is expressly and lawfully stated in writing. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

24. Governing law

These Terms are governed by the laws of Malta, without depriving an eligible consumer of mandatory protections that apply under the law of the consumer's habitual residence where those protections cannot lawfully be excluded. Nothing in these Terms prevents an eligible consumer from using any dispute-resolution or statutory remedy available under applicable law.
